I. INTRODUCTION
This matter comes before the court on the parties’ cross-motions for summary-judgment. The plaintiff brings suit against the Secretary of the Navy (“the defendant”) under the Administrative Procedure Act (“APA”), 5 U.S.C. § 701 et seq., and 10 U.S.C. § 1372(3), challenging a decision by the Board for Correction of Naval Records (“BCNR”) denying the plaintiff the rank of major at retirement.
