MEMORANDUM AND ORDER
GERSHON, District Judge.
Robert Pilchman, plaintiff pro se, brings these actions against defendant Department of Defense alleging that he suffered discrimination in being rejected for enlistment in the Navy’s nuclear propulsion officer candidate program (“NUCPOC”), a program for active duty in the Naval Reserve, primarily because he is an Orthodox Jew. 1 In a previous Memorandum and Or der relating to defendant’s motion to dismiss the first complaint (97 CV 3010) in these actions pursuant to Rules 12(b)(1) and 12(b)(6) for failure to state a claim and for lack of subject…
