This appeal draws into question the constitutionality of §5 (a)(1)(D) of the Subversive Activities Control Act of 1950, 64 Stat. 992, 50 U. S. C. § 784 (a)(1)(D),1 *260which provides that, when a Communist-action organization 2 is under a final order to register, it shall be unlawful for any member of the organization “to engage in any employment in any defense facility.” In Communist Party v.
