Affirming.

This litigation results primarily from the misemployment of the word “trustee,” a word having a fixed, definite meaning in the common law of this country and of England, by the purchaser of land. E. H. Patterson purchased several hundred separate tracts of land in Bell and adjacent counties in the years 1889 and 1890, the deeds,_ at his suggestion and against the advice of counsel, being made to “ E.
