BOOTH, District Judge.

In this suit plaintiff seeks an injunction and damages for infringement of a copyright and for unfair competition in trade. The subject-matter of the claimed copyright is stated by plaintiff to be “a label embodying as the principal and distinguishing features thereof a series of new and original recipes.” The recipes contain detailed directions for making various articles of food and drink, using divers ingredients, including plaintiff’s fruit nectar.
