Appellant was convicted, after a jury trial, of assault with intent to kill with malice, Section 559.180 RSMo 1969, and sentenced to life imprisonment. He raises three points or assignments of error on this appeal. First, he asserts that the court erred in overruling his objection and motion for a mistrial when Detective James Theisen of the Kansas City, Missouri police department testified as to the lineup identification of the defendant by one Roberta Hodges, upon the basis that such evidence was hearsay, inadmissible and highly prejudicial.
