Plaintiffs commenced Mascolo v. Merrill Lynch etc., 72 Civ. 3299, on August 2, 1972 iñ the Southern District of New York. Reilly v. Merrill Lynch etc. was commenced in the Northern District of Texas on July 28, 1972. Both complaints alleged violations of the federal securities laws and sought damages on behalf of all Merrill Lynch customers who purchased stock in Scientific Control Corporation (“SCC”) in 1968 and 1969.
