This appeal is’from a summary judgment granted the defendants below. Suit was instituted in the District Court of Shelby County, Texas, by Hugh Armstreet and wife, Zellene Armstreet, and the Estate of Robert Hampton Armstreet, deceased, appellants, seeking damages against Billy Earl Greer and O. L. Greer and wife, Louise Greer, appellees, for the alleged wrongful death of appellants’ son, Robert Hampton Armstreet, who received fatal injuries in an automobile collision near Shel-byville, Shelby County, Texas, on November 10, 1964.
