Appeal from a judgment of the Supreme Court (Lamont, J.), rendered December 16, 2004 in Albany County, upon a verdict convicting defendant of the crimes of criminal possession of a controlled substance in the third degree, criminal possession of a weapon in the third degree and false personation.

As the result of an investigation into heroin trafficking in the City of Albany, and following two separate controlled buys, members of the Albany County Sheriffs department executed a search warrant at apartment A, 288 Second Avenue.
