Plaintiff Eddy Reyes (“Plaintiff’) filed this action on October 9, 2013, alleging violations of the Family and Medical Leave Act (“FMLA”), 29 U.S.C. § 2601 et seq., and the New York City Human Rights Law (“NYCHRL”), N.Y.C. Admin. Code. § 8-107. (Dkt. 1.) According to Plaintiff, after taking leave under the FMLA, he was not permitted to return to his sales representative position with Defendant Phoenix Beverages, Inc.
