MEMORANDUM AND ORDER

DITTER, District Judge.

By orders dated November 5, 1990, and November 6, 1990,1 refused the motions of defendants, Vincent G. Restivo, John G. Cassidy, Sr., Kevin P. Cassidy, and Francis Santangelo to dismiss plaintiffs amended complaint and the motion of Francis San-tangelo asserting that this court lacked in personam jurisdiction over him and was not an appropriate venue to adjudicate certain claims against him. This opinion will explain my reasons.
