Some of the questions raised in this case are not only interesting, but of such importance as to demand great care in their examination and in the discussion and disposition thereof.

The following statement of the case is taken from the briefs of counsel for the respective parties: In January, 1878, the complainant was an ice company-in Detroit doing a general ice business, and was lessee of a portion of Belle Isle in the Detroit river, consisting chiefly of water front.
