Error to the United States Court for the Western District of the Indian Territory before Justice Sulzbacher, February 13, 1905. G. P. Reynolds was convicted of adultry and brings error.
1Opinion of the CourtClayton, J.
The plaintiff in error was indicted upon a-charge of adultery. Upon arraingnment, aplea of not guilty was entered, and withour any withrawal of the plea, or motion to be permitted to do so, a demurrer to the indictment, followed by a motion to quash, were filed. Both were overruled by the court and exceptions duly taken. A trial to a jury was then has resulting a verdict of guilty. After verdict, motions for new trial and in arrest of judgment were filed.
