STEPHENS, J.

Defendant (Dale Michael Piorkowski) was charged by information with violating Penal Code section 187 (murder), and a jury convicted him of involuntary manslaughter (Pen. Code, § 192, subd. 2). Motion for a new trial was denied, and criminal proceedings were adjourned for a diagnostic study pursuant to section 1203.03. Criminal pro ceedings were reinstated, and defendant was placed on probation for a period of 4 years on the condition that he spend the first 180 days in the county jail. He was given credit for the 73-day period he was detained in jail.
