Order entered August 26, 1985 reversed, without costs, and final judgment of possession granted in favor of petitioner.

The statutory tenant herein was convicted after trial of murder in the second degree and was sentenced in January 1985 to an indeterminate term of 15 years to life. In April 1985 landlord commenced this nonprimary residence proceeding, effecting personal service upon tenant at the correctional *128facility where he is currently incarcerated.
