Following a bench trial, the Marion County Superior Court convicted appellant Ernest Esquerdo of Possession of Cocaine with the Intent to Deliver, I.C. § 35^8-4-1, a Class A felony; Possession of Cocaine, I.C. § 35-48-4-6, a Class C felony; Possession of Marijuana with the Intent to Deliver, I.C. § 35-48-4-10, a Class D felony; and Possession of Marijuana, I.C. § 35-484H1, a class D felony. The trial court merged the .two cocaine charges, as well as the two marijuana charges, and sentenced appellant to 20 years imprisonment for the cocaine offenses,…
