HAYNES, Circuit Judge:

This is an appeal from the retrial of defendant Jason Dvorin, who was convicted of one count of conspiracy to commit bank, fraud. On appeal, Dvorin contends the district court erred by refusing to, give certain requested jury instructions, exclud ing certain admissible evidence but admitting other inadmissible evidence, failing to adequately sanction the government for prosecutorial misconduct, and failing to dismiss the forfeiture notice in his indictment due to prosecutorial vindictiveness.
