In an action, inter alia, to recover damages for failure to procure insurance coverage, the defendant Lincoln Brokerage Corporation appeals, as limited by its brief, from so much of an order of the Supreme Court, Kings County (F. Rivera, J.), dated July 9, 2010, as granted that branch of the plaintiffs motion which was to restore this action to active status.

Ordered that the order is affirmed insofar as appealed from, with costs.
