— In an action to recover damages for the breach of a compromise and settlement agreement, the defendant appeals from (1) an order of the Supreme Court, Queens County (Bambrick, J.), dated April 9, 1987, which granted the plaintiffs motion for summary judgment on the issue of liability and denied its cross motion *675for summary judgment; and (2) a judgment of the same court, dated August 26, 1987, which was in favor of the plaintiff in the principal amount of $78,310.68.

Ordered that the appeal from the order is dismissed; and it is further,

Ordered that the judgment is affirmed; and it is further,
