1DissentBlake, J.

(dissenting) — I cannot acquiesce in a rule which deprives the state of property that is expressly reserved to it in the constitution. For the reasons stated in the dissenting opinion in Smith v. State, 184 Wash. 58, 50 P. (2d) 32, I dissent.

Beals and Geraghty, JJ., and Steinert, C. J., concur with Blake, J.
