Craig, J.:

This was a bill in equity, brought by David Evans, to obtain a construction and enforcement of an alleged trust agreement executed by Mary Williams, for the appointment of a new trustee, and for other relief particularly specified in the prayer of the bill.

Mary Williams died in Chicago February 3, 1891, intestate and without issue, leaving surviving her as heirs, a husband, Charles Williams, with whom she had not lived for over twenty years before her. death, and certain nephews and nieces, descendants of her deceased brothers and sisters.
