Introduction

The plaintiff, James Gomez (hereinafter “Gomez”), has filed this action seeking damages from the defendant, Paxton Municipal Light Department (hereinafter “Paxton”), for injuries he alleges he sustained on May 9, 2000 when a town utility pole, to which he was installing cable, snapped and came down upon him.
