The appellant Judson White appeals the Kanawha County Circuit Court’s order denying the appellant’s petition for a second habe-as corpus hearing. In his appeal to this Court, the appellant argues that the circuit court erred in applying the “concurrent sentence rule” to deny the appellant’s petition. The appellant also argues that he is entitled to a second habeas hearing because the eir-*700cuit court failed to make a finding of compe- , tency on the record in relation to the appellant’s 1986 convictions.
