This is a direct appeal from a conviction for the crime of rape, in violation of K. S. A. 21-3502. The defendant presents three points on this appeal. He contends (1) that the trial court erred in not granting a new trial on its own motion or on the motion of defense counsel, when the victim offered unsolicited remarks concerning defendant’s prior record, namely, a prior conviction; (2) that the evidence is not sufficient to sustain a verdict of guilty; and (3) that the trial court erred in not declaring a mistrial as a result of remarks…
