PICKETT, Circuit Judge.

This is an appeal from a conviction in the United States District Court for the District of Kansas. The appellant Hanks was charged in an information which stated, in substance, that on December 7, 1966, the defendant did wilfully, unlawfully and feloniously make an assault on Fred O. Peterson, a person having lawful custody of a United States Post Office in Kansas City, Kansas, with intent to rob and steal mail matter, money and United States postal money orders which were then in Peterson’s custody, and in attempting to effect such robbery, the defendant put the life…
