The licenses issued by the plaintiff under Pub. Sts. c. 100, by the selectmen of the defendant town having been revoked on the ground that notices of the applications were not posted on the premises described in the applications as required by the sixth section of that statute, the plaintiff brings this action to recover the amount paid by him for the licenses, on the ground that he, supposing that the law as to posting such notices had been complied with, paid the money under a mistake of fact.
