This was an action in replevin, commenced in the district court of Pottawatomie county on the 10th day of June, 1898, by C. D. Waldo, plaintiff in the court below, defendant ,in error, against W. J. Dickerson, sheriff of Pottawatomie county, defendant in the court below;, and plaintiff in error in this court.

The petition alleges that the plaintiff is the owner of and entitled to the immediate possession of twenty-six bales of cotton of the value of $580.09, and that the defendant wrongfully detains the possession of said property, and refuses to surrender the…
