Defendant-appellant, Larry Mynhier, appeals the decision of the Hamilton County Court of Common Pleas revoking his community control and imposing consecutive sentences. For the following reasons, we affirm in part, reverse in part, and remand for resentencing.
Mynhier was indicted on six counts of sexual battery, a third-degree felony, in violation of R.C. 2907.03(A)(5). Pursuant to a plea agreement, Mynhier entered a guilty plea to three counts of sexual battery, and the remaining three counts were dismissed. Honoring the agreed sentence, the trial court sentenced…
