Th-is is an action in claim 'and delivery whereby plaintiff undertakes to recover possession of certain oats, barley, and corn of the total value of $231, and of which plaintiff claims to be the owner. The said grain was raised on plaintiff’s farm during the summer of 1932 by defendant as plaintiff’s tenant. The contract under which defendant occupied said farm was in writing and dated on the 20th day of September, -A. D. 1930.
