*1026In an action to recover damages for medical malpractice, etc., the defendant appeals from an order of the Supreme Court, Kings County (Jacobson, J.), dated May 20, 2004, which granted the infant plaintiffs motion for leave to reargue, and upon reargument, granted the infant plaintiffs prior motion seeking leave to serve a late notice of claim nunc pro tunc, which was denied, without prejudice to renew, in an order of the same court dated October 24, 2003.
Ordered that the order is modified, on the facts and as a matter of discretion, by deleting the provision thereof which, upon reargument,…
