INTRODUCTION

This is a civil action in which the plaintiff, Judi M. Scipione, seeks judicial review pursuant to G.L.c. 30A, §14 of the decision by the defendant, Board of Appeal on Motor Vehicle Liability Policies and Bonds (Board), upholding an insurance premium surcharge imposed by the defendant, Commerce Insurance Company in accordance with the Massachusetts Safe Driver Insurance Plan.1 See G.L.c. 175, §§113B, 113P (under the Massachusetts Safe Driver Insurance Plan, the plaintiffs insurer, Commerce Insurance Company, was required to make a determination as to whether its insured…
