Defendant moves for an order suspending the execution of judgment pending appeal and releasing him on bail.

The defendant herein was convicted, after a jury trial, on September 14, 1993 of criminally negligent homicide and criminal possession of a weapon in the third degree. He was sentenced on October 21, 1993 to two concurrent terms of imprisonment of 16 months to 4 years and is currently serving that sentence in Groveland Correctional Facility.
