In a negligence action to recover damages for personal injuries, etc., defendant appeals from an order of the Supreme Court, Westchester County (Rubenfeld, J.), entered January 31, 1985, which denied her motion to dismiss the complaint pursuant to CPLR 3211 (a) (5).
Order reversed, on the law and the facts, with costs, motion granted and complaint dismissed.
