Defendants appeal from a summary judgment entered on the plaintiffs’ complaint for foreclosure of a land contract and a deficiency judgment in Wayne County Circuit Court.

On November 20, 1969, the plaintiffs as vendors and Marshal Fisher and defendant Charles Burger as vendees entered into a land contract for the sale of a multiple unit apartment building in Detroit. Before he died, Marshal Fisher transferred his interest in the land contract to the trustees of an inter vivos trust.
