The petition of the plaintiff alleges that C. W. Mennig, husband of plaintiff Anna Mennig, died August 28, 1916, seized of certain described real estate set forth in the petition ; that C. W. Mennig left surviving him, as his only heirs at law Anna Mennig, his widow (plaintiff herein), and Helen Mennig, now Helen Mennig Howard, his daughter and only child; that C. W.
