The sole, narrow issue presented in determining whether this court should confirm the Plan of Reorganization (“the Plan”) of CLASSIC CHEMICAL AND SUPPLY COMPANY, INC. (“the Debtor”) is whether the Debtor has met the burden of establishing that its designation to apply the payments of the Debtor on its liabilities to the Internal Revenue Service (“the IRS”) first to trust fund liabilities which the Debtor shares -with its principal, David Bruce Moss, “is necessary to the success of [the] reorganization plan,” pursuant to the holding of United…
