Presently before the Court is the “Motion for Partial Summary Judgment of Defendant, Gould Electronics, Inc. (hereinafter “Gould”), to dismiss claims of David and Linda Miller for Diminution in property value and loss of use and enjoyment of property as set forth in Counts II, III and IV of Complaint pursuant to Rule 56(b) of the Federal Rules of Civil Procedure” (Doc. 62).
