OPINION AND ORDER
ACOSTA, District Judge.
Plaintiff, the Federal Deposit Insurance Corp. (“FDIC”), instituted this action for collection of monies and foreclosure of mortgage after the collapse of Banco Crédito y Ahorro Ponceño (“Banco Crédito”). The FDIC has moved this Court to set aside the judgment previously entered in this case dismissing the second cause of action as time barred with respect to defendants Pedro A.
