The plaintiffs, ABI Investment Group (“ABI”) and Robert S. Audley, brought an action against the Federal Deposit Insurance Corporation in its capacity as receiver for the Hillsborough Bank and Trust and the Hills-borough Bank and Trust Company (“FDIC/Receiver”), in its corporate capacity (“FDIC/Corporate”), and against Banc One New Hampshire Asset Management Corporation (“BONHAM”).
