Jay Moser and Dana Moser appeal from the district court’s order denying their motion to reconsider and dismissing their complaint with prejudice. The Mosers argue that because the case previously had been dismissed without prejudice, the district court did not have the power to dismiss the ease with prejudice on their motion to reconsider an order denying their motion to vacate. Further, the Mosers argue that even if the district court did have the power to dismiss the case with prejudice, the court abused its discretion in doing so. We find that the…
