MEMORANDUM OPINION AND ORDER

KANE, District Judge.

Petitioner filed this habeas-corpus action under 28 U.S.C. § 2254. He argues that he is entitled to credit for the time that he spent in pre-sentence confinement. This court has jurisdiction under id. § 2241. I deny the writ.

Petitioner was arrested on June 29, 1979. On July 5 his bail was set at $5000. He did not post this bail, nor did he move to reduce it, nor did he seek release on his own recognizance.
