Factual Background

To recapitulate, plaintiffs filed a tort action against a number of defendants, including the American Samoa Government (hereafter the "government"). A tort claim against the government is regulated by the Government Tort Liability Act, A.S.C.A. §§ 43.1201 et seq., (hereafter the "G.T.L.A."). Before the government can be sued in tort, an administrative claim must be first pursued with the Attorney General, and in accordance with regulations established by the Governor, the Attorney General is empowered to settle such claims.
