MacDade, J.,

On July 7, 1937, plaintiffs filed a bill in equity against defendants, and averred therein that defendants gave to a real estate development, in which they are financially interested, the name of “Rose Valley Acres”, without the consent of or consultation with the people of or authority from the Borough of Rose Valley, the latter claiming for Rose Valley a certain goodwill and reputation, upon which the development therefore unlawfully encroaches.
