Tbe appellant was tbe plaintiff in tbe court below and filed suit for damages for tbe breach of a contract made between tbe appellant and tbe appellee for tbe hauling of timber upon certain lands belonging to tbe appellee. Tbe parties estimated the timber to be ten million feet, and that it would take, approximately, fourteen months for it to be logged.
