The following statements of the nature of the case we take from appellee’s brief:

“On the 14th day of October, 1899, appellee and his wife, Sophia Holt, were passengers on a car of the Rapid Transit Railway Company, a street railway company operated in the city of Dallas. They took passage on the car in the business portion of the city on Commerce street for the purpose of being transported to the fair grounds.
