By his petition in this action in Count I, Plaintiff Arch Smith sought to recover against Defendants John Q. Hammons and John Q. Hammons Entertainment, Inc., upon a verbal contract for Plaintiff to produce and perform in a magic show. By Count II, the Plaintiff sought to recover in quantum meruit for providing valuable expertise in the entertainment business and other valuable services to Defendants.
