GUTIERREZ, Chief Judge.
Arlyn V. Orr appeals from his judgment of conviction following a jury verdict finding him guilty of resisting and obstructing officers. For the reasons set forth below, we affirm.

FACTS AND PROCEDURE
While on patrol at approximately 12:20 a.m., Deputy Shawn Scott noticed a vehicle in a public parking lot. As he approached, Deputy Scott observed the car was running with a person who appeared to be asleep in the driver’s seat and five open cans of beer inside.
