On original submission, the State appealed the trial court’s grant of an application for writ of habeas corpus that vacated appellee Rahul Sudhakar’s nolo contendere plea as involuntary under Padilla v. Kentucky, 559 U.S. 356, 130 S.Ct. 1473, 176 L.Ed.2d 284 (2010). On December 6, 2012, this Court issued an opinion affirming the trial court’s grant of habeas relief and vacating his nolo contendere plea.
