*429The plaintiff Deborah Moore alleges that she was injured when the vehicle in which she was a passenger was struck in the rear by the defendant’s vehicle. The defendant’s motion for summary judgment dismissing the complaint on the ground that Moore had failed to sustain a "serious injury” as defined by Insurance Law § 5102 (d) was initially granted by the court on the basis that Moore had failed to show permanency of the injuries or significant limitation.
