HINCKS, Circuit Judge.

The appellee, R. T. Jones Lumber Company, brought a libel to recover damages occasioned by the failure of the appellant, Roen Steamship Company, to deliver part of a lumber cargo shipped on its barge Hilda. Judge Burke found the appellant liable on the ground that the unseaworthiness of the Hilda, rather than a “peril of the sea,” directly caused the cargo to fall and be lost into the seas during a severe storm.
